Terms of Service and End-User License Agreement

1. Acknowledgement

You and Levin Media ("Licensor") acknowledge that this End-User License Agreement ("EULA") is concluded between You and Licensor only, and not with Apple. Licensor, not Apple, is solely responsible for the BetterList application ("Licensed Application") and the content thereof. This EULA may not provide for usage rules for the Licensed Application that are in conflict with the Apple Media Services Terms and Conditions as of the Effective Date (which You acknowledge You have had the opportunity to review). 2. Scope of License

The license granted to You for the Licensed Application is limited to a non-transferable license to use the Licensed Application on any Apple-branded products that You own or control and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions, except that such Licensed Application may be accessed and used by other accounts associated with the purchaser via Family Sharing or volume purchasing.

3. Description of Service

BetterList is a checklist and task management application for iOS. Features include:

• Creating and managing checklists
• Focus Mode for distraction-free task completion
• AI-powered features (photo-to-list, voice-to-list, tidy up) with premium subscription
• Sharing and collaboration features with premium subscription

4. Account Registration

Certain features require you to sign in with your Apple ID. You are responsible for maintaining the security of your Apple ID and for all activities that occur under your account.

5. Subscriptions and Payments

BetterList offers a Pro subscription tier at $4.99/month. Key terms:

• Payment will be charged to your Apple ID account at confirmation of purchase
• Payments are processed through the Apple App Store
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage and cancel subscriptions in your Apple ID settings
• Refunds are handled in accordance with Apple's App Store policies
• Free trial periods, if offered, convert to paid subscriptions unless cancelled

6. Maintenance and Support

Licensor must be solely responsible for providing any maintenance and support services with respect to the Licensed Application, as specified in this EULA, or as required under applicable law. You and Licensor acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Licensed Application.

7. Warranty

Licensor must be solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the Licensed Application to conform to any applicable warranty, You may notify Apple, and Apple will refund the purchase price for the Licensed Application to You. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Licensed Application, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty will be Licensor's sole responsibility.

8. Product Claims

You and Licensor acknowledge that Licensor, not Apple, is responsible for addressing any claims of You or any third party relating to the Licensed Application or Your possession and/or use of that Licensed Application, including, but not limited to: (i) product liability claims; (ii) any claim that the Licensed Application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation. This EULA may not limit Licensor's liability to You beyond what is permitted by applicable law.

9. Intellectual Property Rights

You and Licensor acknowledge that, in the event of any third party claim that the Licensed Application or Your possession and use of that Licensed Application infringes that third party's intellectual property rights, Licensor, not Apple, will be solely responsible for the investigation, defense, settlement and discharge of any such intellectual property infringement claim. BetterList and its original content, features, and functionality are owned by Levin Media and are protected by international copyright, trademark, and other intellectual property laws.

10. Legal Compliance

You represent and warrant that (i) You are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) You are not listed on any U.S. Government list of prohibited or restricted parties.

12. Third Party Terms

You must comply with applicable third party terms of agreement when using the Licensed Application (e.g., You must not be in violation of Your wireless data service agreement when using the Licensed Application).

13. Third Party Beneficiary

You and Licensor acknowledge and agree that Apple, and Apple's subsidiaries, are third party beneficiaries of this EULA, and that, upon Your acceptance of the terms and conditions of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against You as a third party beneficiary thereof.

14. Collaboration and Shared Lists

Pro subscribers can share lists and collaborate with others:

• List owners control who has access to their shared lists
• Content shared in lists is visible to all collaborators
• You are responsible for any content you add to shared lists
• Collaborators can be removed by the list owner at any time

15. Acceptable Use

You agree not to:

• Use the service for any illegal activities
• Upload content that violates the rights of others
• Attempt to gain unauthorized access to our systems
• Use the service to harass, abuse, or harm others
• Distribute malware or other harmful content

16. AI Features

AI-powered features use third-party services (OpenAI) for processing:

• AI results may not always be accurate
• You are responsible for reviewing and editing AI-generated content
• We are not liable for errors in AI processing

17. Account Deletion

You can delete your account at any time from the Account tab in the app. Upon deletion:

• Your account and associated data will be permanently removed
• Shared lists you own will be deleted
• Your subscription will NOT be automatically cancelled—you must cancel separately through Apple

18. Disclaimer of Warranties

The service is provided "as is" without warranties of any kind, either express or implied. We do not warrant that the service will be uninterrupted, secure, or error-free.

19. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the service.

20. Changes to Terms

We may update these Terms of Service from time to time. Changes will be reflected by updating the "Last Updated" date. Continued use of the service after changes constitutes acceptance of the new terms.

21. Governing Law

These terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.
